These Terms of Service ("Terms") govern your use of the MedSanctuary website and the facilitation services provided by บริษัท เมดิ แซงชัวรี่ จำกัด (Medi Sanctuary Co., Ltd.), company registration number 0135569015158, registered in Pathum Thani, Thailand ("MedSanctuary", "we", "us", "our"). By accessing our website, submitting an enquiry, or engaging our services, you ("you", "the patient", "the client") agree to these Terms.

Please read carefully. MedSanctuary is a medical tourism facilitator and coordinator. We are not a hospital, clinic, or medical provider, and we do not perform, supervise, or direct any medical or surgical treatment. All clinical care is provided by independent, licensed hospitals and surgeons with whom you contract directly.

01Our Role as a Facilitator

MedSanctuary provides coordination and concierge services that may include: helping you understand treatment options, arranging consultations with independent surgeons, coordinating quotations, scheduling, organising accommodation and airport transfers, interpreting and translation support, and assisting with logistics before, during, and after your treatment journey.

We act solely as an intermediary between you and third-party providers, including but not limited to hospitals, surgeons, anaesthetists, accommodation providers, and transport operators. We do not provide medical advice, diagnosis, or treatment, and nothing on our website or in our communications should be interpreted as medical advice.

02Medical Care & Independent Providers

Your medical and surgical treatment is provided by independent, licensed third-party practitioners and facilities. You enter into a direct relationship with these providers for all clinical matters.

  • All decisions regarding your suitability for treatment, the treatment plan, surgical technique, and clinical outcomes are made solely by your treating surgeon and medical team.

  • Informed consent for any procedure is given by you directly to the treating provider, in accordance with that provider's protocols and applicable Thai law.

  • MedSanctuary does not guarantee, warrant, or assume responsibility for the quality, safety, results, or outcomes of any medical treatment.

  • Medical outcomes vary between individuals. No specific result can be promised, and any examples, testimonials, or before-and-after material are illustrative only and not a guarantee of your own outcome.

03Enquiries, Quotations & Pricing

Indicative package prices shown on our website (for example "from AUD $8,999 all-inclusive") are estimates provided for general guidance and are subject to change. A binding price is confirmed only in a written quotation issued to you after assessment by the relevant provider.

Quotations are valid for the period stated within them and may be revised if your medical assessment, chosen procedures, travel dates, or third-party costs change. Currency conversions are approximate and the final amount may vary with exchange rates at the time of payment.

04Payments, Deposits & Refunds

Payment terms, deposits, and refund conditions are set out in your individual quotation or service agreement. Where MedSanctuary collects a coordination or facilitation fee, this fee covers our services and is separate from amounts payable to hospitals, surgeons, or other providers.

  • Deposits may be non-refundable where they have been used to secure surgical dates, hospital bookings, or third-party services on your behalf.

  • Amounts paid directly to or on behalf of third-party providers are subject to that provider's own refund and cancellation policy.

  • Refund requests are assessed on a case-by-case basis and in line with the terms of your agreement and any applicable law.

05Your Responsibilities

To allow us to coordinate your journey safely, you agree to:

  • Provide complete, accurate, and honest information about your medical history, current medications, and health status.

  • Disclose any condition that may affect your suitability for treatment or travel.

  • Hold a valid passport and obtain any required visa for travel to Thailand.

  • Arrange appropriate travel and medical insurance; we strongly recommend coverage that includes overseas medical treatment and complications.

  • Follow the pre-operative and post-operative instructions given by your treating provider, including guidance on fitness to fly.

  • Make your own informed decision about whether to proceed with treatment.

06Travel, Accommodation & Third-Party Services

Where we assist in arranging flights, accommodation, transfers, or other third-party services, those services are supplied by independent providers under their own terms and conditions. MedSanctuary is not liable for the acts, omissions, delays, cancellations, or service failures of any third party.

07Limitation of Liability

To the maximum extent permitted by law, MedSanctuary's total liability arising from or connected with our facilitation services is limited to the amount of the facilitation fee actually paid by you to MedSanctuary.

We are not liable for any indirect, incidental, consequential, or special loss, including loss of income, loss of opportunity, or any harm, injury, complication, or dissatisfaction arising from medical treatment provided by an independent third-party provider.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under applicable law, including the Australian Consumer Law where it applies to you.

08Privacy & Confidentiality

We collect and handle personal and health information only as necessary to coordinate your treatment journey, and in accordance with our Privacy Policy. By engaging our services, you consent to us sharing relevant information with the hospitals, surgeons, and providers involved in your care. We take reasonable steps to keep your information secure and confidential.

09Intellectual Property

All content on this website — including text, logos, the MedSanctuary name and emblem, photography, graphics, and design — is owned by or licensed to MedSanctuary and is protected by copyright and trademark law. You may not reproduce, distribute, or use this content without our prior written permission.

10Website Use

The information on this website is provided for general informational purposes only and does not constitute medical advice. While we take care to keep information accurate and current, we make no warranty that it is complete, error-free, or up to date. You should not rely on website content as a substitute for professional medical consultation.

11Changes to These Terms

We may update these Terms from time to time. The current version will always be available on our website, with the "last updated" date shown at the top. Continued use of our website or services after changes are published constitutes acceptance of the revised Terms.

12Governing Law & Disputes

These Terms are governed by the laws of the Kingdom of Thailand. We aim to resolve any concern directly and in good faith. Where a dispute cannot be resolved informally, it will be subject to the jurisdiction of the courts of Thailand, without affecting any non-excludable rights you may have under the consumer laws of your home country.
